The introduction of the Bharatiya Nyaya Sanhitas has altered the landscape of criminal law in India. In this post I do not wish to comment on the substantive changes these new Acts make to Indian criminal law. Rather, I wish to address the claim that they mark an important step in ‘decolonising’ the law, since the criminal law regime they replace was put in place by the colonial state, with little by way of input by Indians.
